Thank You from Circuit Riders For Stratton


Thank you for supporting Justice Evelyn L. Stratton! Two and one-half million (2.5 million) Ohioans voted for Justice Stratton, nearly as many as voted for each presidential candidate. She carried 87 counties, came very close to carrying all 88 counties, and was returned for her third term on the Ohio Supreme Court.

Congratulations to all candidates we met, win or lose. We are proud to be associated with such hard working and dedicated Ohioans.

Circuit Riders For Stratton made our goal, too. We rode to all 88 counties in six months. We traveled over 13,000 miles inside Ohio and attended 107 events. That is an average 70 miles per day and one event every other day. Most importantly, we made lifelong friends of all of you and many others all across the state.

Dear Supporters,
I am personally asking for you final round of help in our campaign as I am very concerned about new developments. I have so appreciated all you have done, but WE STILL NEED YOUR HELP.
We knew that out name ID according to the Columbus Dispatch poll was 16% to our opponent's 12%. We have now just learned that the Obama camp has sent out 5 million slate cards with our opponents name on them. A friend of mine stood in a line to vote yesterday for two hours, and almost everyone in the line had that slate card in hand. This alone could make the difference in this campaign.
We have spent every dollar we have available on TV ads but that will not be enough. We need a major grass roots effort to counteract that 5M!!!!
Please join our email campaign which we call the POWER OF SEND. On our web site, www.strattonforsupremecourt.com, are two email messages, one about my court work and one about my adoption and mental health work, as well as a copy of the mental health flyer that you could attach to each email.
Please ask other lawyers, associates, law clerks, secretaries, clients, friends, FAMILY--anyone-- to join in the email campaign and get as many sent out as possible. A personal word from you can be the difference as to whether that person votes for the Supreme Court as no one knows who the justices are! It will count far more than a 15 second ad they may not ever even see!
My opponent, while a good person, has a very different philosophy. He has many times stated that tort reform is unconstitutional, and in Wed.'s debate in Cincinnati, when asked by the moderator whether it was proper for a justice to "represent the injured guy against the big corporations" (as he has been quoted), said that it was proper for a justice to do so. I don't think we want that bias on the bench-we want someone who will be fair to all who are before him, not representing a side as a judge!!!

Election will be courting disaster

This year's election is shaping up to be very consequential. Ohio is a key state in the presidential campaign.

Voters will consider as many as five statewide ballot issues and there are several closely contested races for Congress and the Ohio House and Senate.

Marc Dann's resignation created an unexpected election for the office of attorney general and, in communities across Ohio, voters will consider a slew of local issues and races for local offices.

Because of the number of important issues and races this year, the two Ohio Supreme Court races are not generating much attention. This is unfortunate, especially in light of the importance this election will have on the direction of the court.

It wasn't so long ago that the court regularly found itself mired in political controversy. During the 1990s up to 2002, a majority of the justices regularly substituted their own personal policy preferences for that of the Legislature.

For example, the court struck down the school funding system on four separate occasions, nearly creating a budget crisis for the state of Ohio. The court also went out of its way to strike down much needed reforms to Ohio's workers' compensation and civil liability systems as well.

Ohioans grew tired of the court acting as a super-legislature on such public policy matters and as the activist justices retired, voters elected new justices who pledged to apply the law in a neutral and fair manner consistent with the Ohio Constitution.

Today, a new majority exists on the court that exercises restraint by respecting the lawmaking function of the legislative branch and refuses to second-guess the General Assembly on public policy matters.

For example, the court recently upheld Ohio's charter school law and statutes reforming the workers' compensation and civil liability systems. Regardless of their personal views on these matters, a majority of the current justices realize that their role is to apply these laws in a neutral and fair fashion, not to substitute their own personal policy preferences for that of the legislature.

A new report published by the Federalist Society entitled A More Modest Court: The Ohio Supreme Court's Newfound Judicial Restraint, documents the court's recent return to a more traditional judicial role. The authors, Case Western Reserve law professor Jonathon Adler and Christina Adler, conclude that the court's commitment to providing "greater deference to legislative enactments" and resisting "expanding bases for tort liability" has resulted in a "more modest supreme court."

Similarly, a recent report from the Manhattan Institute, Judging Ohio, reports that "Ohio's once-threatening legal environment is looking friendlier and fairer, thanks in no small part to the electorate's decision to install new judges who are less willing to substitute their policy preferences for the legislature's political will."

While the transformation of the court is significant, it could be short-lived. Two of the justices who make up this new majority committed to restraint - Maureen O'Connor and Evelyn Lundberg Stratton - are up for reelection. O'Connor's opponent, Cuyahoga County Common Pleas Judge Joseph Russo, pledges "a different perspective" and Stratton's opponent, Cuyahoga County Juvenile Judge Peter Sikora, offers to bring "change" to the Ohio Supreme Court.

This "change" toward a "different perspective" might actually look very familiar. It would likely resemble the activist Ohio Supreme Court of days gone by. In fact, Sikora publicly criticized the court's current commitment to restraint, claiming the court got it wrong when it recently upheld statutory civil liability reforms, including caps on "pain and suffering" damages, which have helped to restore balance to Ohio's legal system.

If Stratton and O'Connor, who voted with the 5-2 majority, are replaced by activist justices, a new four-person majority hostile to such statutory reforms would likely emerge. And we would be back to the days of a politicized high court acting as a super-legislature from the bench.

As election day approaches, voters must decide whether they want to go back to the days when the Ohio Supreme Court regularly inserted itself into various political controversies or stay with the court's current approach of judicial restraint and modesty.

Circuit Riders For Stratton Reach 86th County & 12,000 Miles

Cincinnati, OH, October 10, 2008. Circuit Riders For Stratton rode into their 85th and 86th Ohio counties today. They visited campaign headquarters and spoke with voters in Hamilton and Butler counties in SW Ohio.

The attached photo shows Circuit Riders For Stratton, Pete & Donna Miller, at the Great American Ball Park in Cincinnati today. The Great American Ball Park is the home of the Cincinnati Reds.

Circuit Riders For Stratton have now ridden 12,072 miles riding the circuit inside Ohio since April 26th!

Their goal of riding to all 88 Ohio counties is schedule to be reached on October 16th when Circuit Riders For Stratton attend a Stratton For Supreme Court fundraiser in Williams County and meet with voters in Defiance County. The last two counties are both located in far NW Ohio.

Incumbents Stratton and O'Connor have performed well on state's highest court

For justice of the Ohio Supreme Court, The Dispatch endorses Republican incumbents Evelyn Lundberg Stratton and Maureen O'Connor in the Nov. 4 election.

Their combined legal and public-service experience is an asset that should be preserved on the court.

• Justice Evelyn Lundberg Stratton's public-sector career began as a judge on the Franklin County Common Pleas Court from 1989 through March 1996, when she was appointed by Gov. George V. Voinovich to replace retiring Supreme Court Justice Craig Wright. She was elected to a full term in November 1996 and has served since.

As a trial-court judge, Stratton became aware of how mental illness is often a factor in crime. This impelled her to educate herself on the issue and to champion the development of special courts to handle such cases, putting such offenders into programs that could help keep them out of jail. Thanks to her efforts, as of June, 28 counties in Ohio had mental-health courts and several more counties were planning to adopt them. Stratton is a national authority on the issue.

• Justice Maureen O'Connor became a magistrate for the Summit County Probate Court in 1985, where she served for eight years before being elected as a Summit County Common Pleas Court judge. She's pro-law-enforcement, having served in the mid-1990s as Summit County prosecutor and then taking over in 1999 as lieutenant governor and director of the Ohio Department of Public Safety under Gov. Bob Taft. She was elected to the Ohio Supreme Court in 2002.

She's been working on a court-security task force. Currently, the 88 county courthouses run the gamut of security configurations and rules, and sometimes courts share their buildings with other offices. The task force educates county court personnel about security issues and makes on-site visits to provide recommendations.

Overall, both justices have demonstrated the judicial restraint that should characterize members of a state's high court -- with two notable exceptions.

The first was a 7-0 ruling in 2005 that sealed the addresses of public employees -- information that previously had been public. These addresses had frequently helped in investigations of malfeasance by public employees. There was no compelling justification for closing the records.

The second was a 2006 ruling granting the governor the power to withhold from the public his written communications with his lieutenants. Neither the Ohio Constitution nor the legislature gives the governor such a right to shield the functions of his office.

The Dispatch hopes that these rulings are anomalies and that both justices will defend public access to the operations of government in future decisions.

The Dispatch urges voters to retain both Stratton and O'Connor on the high court.

Circuit Riders For Stratton Battle Severe Weather a Third Time!

Washington Court House, OH, September 14, 2008 (CRFS Newswire): For the third time this year, Circuit Riders For Stratton battled severe weather to ride and meet voters in all 88 Ohio Counties.

A fast moving windstorm, with hurricane force winds, bore down on the Washington Court House Scarecrow Festival and the Fayette County GOP Picnic in this Central Ohio city this afternoon.

"It was very scary," said Circuit Rider For Stratton Donna Miller. "Tents were blowing down and families with small children were running for cover everywhere. Washington Court House and Fayette County first-responders did an excellent job of preventing injuries at the festival."

"As we rode from the festival to the Fayette County GOP Picnic on the outskirts of Washington Court House, we avoided downed trees and rode past darkened homes," added Pete Miller. "Many local residents had fled to the safety of Jack DeWeese's barn, where the picnic was being held."

Circuit Riders For Stratton thanked picnic attendees who were working so hard to reelect Ohio Supreme Court Justice Evelyn Stratton.

Earlier this year, a tent came crashing down on top of Pete and his Harley during a freak gusty wind and rain storm in Delaware County. Later, Pete & Donna were driven back fifty miles on their Harley through Paulding, Van Wert, Mercer and Darke Counties by dramatic cloud-to-ground lightening and torrential rains in another severe storm with a tornado watch attached.

"Those first pioneering Ohio judicial circuit riders way back in 1803 were really brave men," added Donna. "They road all year on horseback and had no warning of bad weather or a GPS or Harley to ease their ride. But they, like us, had wonderful Ohio citizens to protect them and to show them the way."

Circuit Riders For Stratton Welcome OFRW to Fall Conference

10,000 miles to reelect Justice Evelyn L. Stratton!

Upper Sandusky, OH, September 10, 2008 (CRFS Newswire): Circuit Riders For Stratton marked their 10,000th mile on Ohio roads here in Upper Sandusky, OH, today.

The milestone was met as the Circuit Riders For Stratton rode into the Wyandot County Fair, which is the 21st county fair visited by Circuit Riders For Stratton this year.

"The most important statistic'" said Circuit Riders For Stratton Leader Pete Miller, "are the countless number of voters we have met at 75 events in 80 Ohio counties."

"We are proud to be able to ask people to vote to reelect Ohio Supreme Court Justice Evelyn L. Stratton, because she will continue to provide the fair justice that all Ohioans deserve."

Miller added that Circuit Riders For Stratton began riding on April 26th and should achieve their goal of reaching voters in all 88 Ohio counties by Election Day.

Circuit Riders For Stratton Reach 80th County

Wilmington, OH, September 6,2008. Warren County, near Cincinnati in SW Ohio, became the 80th Ohio County visited by Circuit Riders For Stratton.

Today's talks with local voters in South Lebanon, OH, capped off an historic 300 mile ride that included first time visits to Adams, Brown, Highland and Clermont Counties, plus a stop at the Highland County Fair in Hillsboro.

Because we are commemorating the 205th anniversary of the Ohio Supreme Court, we always ride with a sense of history. This particular ride was very historic because part of it followed the western path of the first Ohio judicial circuit riders over two centuries ago:
  • We rode our big Harley out of Chillicothe, Ohio's first state capital, in a morning fog and headed toward Cincinnati.
    • By 1800 Cincinnati had become a sizable frontier town with over 5,000 male inhabitants and was certainly a destination for the first judicial circuit riders.
    • That number of male citizens had, by law (the Northwest Ordinance), allowed Ohio to petition and obtain statehood in 1803.
  • Our feeling of history was confirmed when we reached The Bradford Tavern at West Union in Adams County.
    • Built ca 1804 on the Maysville to Zainsville Stage Couch Route, the Bradford Tavern was certainly a must stop for all travelers in this part of the state.
    • Today, the building is Ohio's longest standing inn still in use and is called the Olde Wayside Inn.
We finished the ride with stops at a reception for Justice Stratton and at the Clinton County Corn Festival, both in Wilmington. Thanks to Stratton For Supreme Court Clinton County Coordinator, Connie Roberts, and her husband, Max, for hosting us at both events!

Circuit Rider For Stratton Addresses Scioto County Fall Rally

Portsmouth, OH, September 6, 2008. It is hard to be the opening act for an Ohio Supreme Court Justice who doesn't need one. If you do it three days before she arrives in town, I guess it is OK.

Circuit Riders For Stratton were honored today when I was invited to address the 2008 Scioto County Republican Party Rally in downtown Portsmouth.
  • In keeping with the Sarah Palin theme set by rally speaker and State GOP Central Committee Member Kay Ayres, I warmly thanked the audience and encouraged them to support the reelection to the Ohio Supreme Court of a goat tying champion, a tractor pull champion, a hiker and a fly fishing-person, whom they all know, love and respect, Justice Evelyn L. Stratton, otherwise known as the Velvet Hammer.
  • John McCain's southeast Ohio Campaign Manager, State Senator John Cary, preceded me. So I put on my 'maverick' biker hat and asked the crowd of 50-100 people to ride with Circuit Riders For Stratton.

Circuit Riders For Stratton Attend 9 Cuyahoga County LD Events; Go Over 9,000 Miles!

Berea, OH, September 1, 2008. Circuit Riders For Stratton barn-stormed Cuyahoga County this Labor Day Weekend and surpassed the 9,000 mile mark on riding the Ohio Circuit!

Thanks to everyone we spoke with at these nine Cuyahoga County Labor Day Weekend Festivals:

* Ohio's Largest Middle Eastern Festival at St. Elias Church in Brooklyn

Stratton Receives Highest Ratings from Cleveland Lawyers

Columbus----Ohio Supreme Court Justice Evelyn L. Stratton has again earned the highest ratings of all candidates running for the Ohio Supreme Court. Stratton, running for her third term on the high court, was rated "excellent" and "preferred" by the Judicial Candidates Rating Coalition in Cuyahoga County.


The Cleveland Metropolitan Bar Association and Cuyahoga County Criminal Defense Lawyer's Association gave her an "Excellent" rating, as did the Ohio Women's Bar Association. The Norman S. Minor Bar Association awarded her a "Good-Preferred" designation.

According to the Coalition, a rating of "Excellent" means the candidate is "a superior choice for office, extremely well-qualified, with exceptional skills."

"I am very gratified to receive the recommendations of these respected Cuyahoga County legal organizations. Their screening process was tough and very thorough," Justice Stratton added.

These ratings of Cleveland attorneys mirror the 2008 "Highly Recommended" statewide bar rating that Justice Stratton already received from the Ohio State Bar Association. Again, Justice Stratton was ranked above all other candidates for the high court.

Kasich, Harris & Husted Endorse Justice Stratton And Her Circuit Riders

Ashland, OH, August 20, 2008. Ohio Senate President Bill Harris and former Ohio Congressman John Kasich told us tonight that they both support Justice Evelyn L. Stratton for re-election to the Ohio Supreme Court.

Senator Harris said that "Evelyn Stratton is one of the finest people I have ever met. She is a great lady. We love her here in Ashland County. We need to see her re-elected!"

John Kasich said that he knows and supports Justice Stratton and 'grilled' us for more details about the 'incredible' Violet Moon Story, which he saw and was touched by on NBCTV-4 in Columbus. For a moment we thought that WE were on Fox-TV's The O'Reilly Factor, which John hosts when Bill O'Reilly is away.

As John left to drive home to see one of his twin eight-year-old daughters, who started the third grade today, he said, "I support what you (Circuit Riders For Stratton) are doing. Good Luck! Ride Safe!

Germantown, OH, August 23, 2008. The Speaker of the Ohio House of Representatives, Jon Husted, told us today that he supports the re-election of Justice Evelyn Stratton. "We need her and more judges like her who do not legislate from the bench," The Speaker said.

Speaker Husted was among a large group of Montgomery County Republicans welcoming Circuit Riders For Stratton to their 75th county today.
